3 Facts About Accident Compensation

Accident Compensation McKinney, TX

When you have been injured in a car accident, you may be confused on how your compensation is calculated. There are a lot of misconceptions and myths surrounding accident compensation. Joe Lucé always wants our clients to be well informed about their case and what they can expect. Here are a few facts about accident compensation and how much you can expect to receive.

1) You Pay for Your Fault

In Texas, when you are in an accident, you receive compensation that is discounted by a “modified comparative fault” rule. In short, the court calculates your fault and compensation is discounted accordingly. For example, if you were hurt in a car accident but you were determined to be 20% at fault, your compensation would be discounted 20%. If the court finds that you were 51% or over at fault for your accident, you would receive nothing.

2) Insurance Companies Are Not on Your Side

When you are injured and seeking compensation, one of the biggest obstacles you will face is dealing with the insurance companies. While they may act helpful, they are looking out for their best interest and their bottom line. They will try and resist paying your claim and will pressure you to settle for way less than your case is worth. You shouldn’t have to deal with the insurance company. Call an experienced attorney like Joe at Lucé Law to assert your rights.

3) Attorneys Do Not Cost Anything Upfront

When it comes to injury cases, attorneys often take them on a contingent fee basis. This means that you do not pay anything unless you receive compensation. If you do not receive anything, your attorney does not receive any compensation either. When you do receive compensation, the attorney will take out a percentage to cover fees and expenses. The amount varies from attorney to attorney. Discuss this with your attorney when you sign your client agreement.
