We, as people, often thrust ourselves headfirst into relationships. We long for that loving embrace of a partner; someone who will support us and comfort us in times of hardship. That partnership, however, is a two-way street. Sometimes, one partner is not happy in the relationship. Divorce is a legal decree that legally ends a marriage before the death of either spouse. During the proceedings, the court may resolve child custody, the division of assets, and alimony. However, there are other options for short terms marriages, such as annulment. Let’s discuss these.

Divorce

When considering divorce, spouses may choose between a “no-fault” or “fault-based” divorce.

  • No-Fault: Allows a spouse to file for divorce without blaming their partner.
  • Fault-Based: Grounds for a fault-based divorce include adultery, abandonment and cruelty.

Annulment

An annulment is a legal decree which makes the marriage null and void. The court will grant an annulment if they find a marriage is invalid based on certain statutory grounds such as fraud and the parties have not lived together since discovering the fraud or existence of other statutory grounds for the annulment. Then, the marriage itself will be treated as if it had never existed.
