Earlier this month, we reported on a hit-and-run accident involving a McKinney teen and a group of construction workers. Unfortunately, the construction worker who was rushed to the closest hospital in critical condition has passed away. Early Monday, McKinney police revealed that Jose Rivera, 51, passed away six days after the accident took place. The driver of the vehicle was arrested shortly after the incident.
Thankfully, the two other construction workers struck by the oncoming vehicle managed to walk away with minor cuts and bruises.
The Incident & Subsequent Charges
The teen who was driving the vehicle was initially charged with three counts of an accident involving personal injury or death. One of those charges has now been upgraded to a second-degree felony. It has also been noted that the driver of the vehicle has been moved from the Collin County Jail, presumably to a higher-security facility close by.
Wrongful Death Cases
When someone thinks of a wrongful death, they often imagine accidents taking place at work – on a construction site, for example. A fatal accident can take place at any point and any place, including while walking home from the store. The most common causes of wrongful death are car collisions and workplace accidents.
With a wrongful death lawsuit, the surviving family members and spouses have a legal right to pursue damages and claims where necessary. If the death was caused by negligence, the family has a right to recover medical bills, lost wages, pain and suffering, loss of support, and loss of companionship.
You will want to speak with an experienced wrongful death attorney, as navigating the insurance companies at a time like this is beyond stressful when alone.
